Terms of sale
Article 1 Purpose and scope
These General Terms and Conditions of Sale govern distance sales concluded on the website lafermedelaruchotte-eshop.com between SARL La ferme de la Ruchotte, SIREN 108 394 248, whose registered office is at La Ruchotte, 21360 Bligny-sur-Ouche, France (the “seller”), and any natural person acting for purposes outside their trade or profession (the “customer”). Sales to businesses are subject to separate terms or to an express adaptation.
Article 2 Products
The website may offer, among other things, kitchen and tableware items, books, knives and accessories, fine food products such as spice blends, oils and vinegars, clothing and accessories, and merchandise such as guitar picks, stickers, pins, corkscrews and mugs.
The essential characteristics, composition, relevant dimensions, price and any restrictions are presented on each product page. Customers should read the applicable instructions, warnings, allergens, storage conditions and any age or import restrictions. Photographs illustrate the products but do not replace their contractual description.
Article 3 Prices
Prices displayed to consumers are in euros including all taxes, unless clearly stated otherwise. Shipping costs, duties, taxes and any other applicable charges are shown before the order is finally confirmed. The seller may change its prices for the future; the price charged is the one displayed when the order is placed, except in the case of an obvious error, which the seller reports to the customer without delay.
Article 4 Orders
The customer selects the products, checks the basket, enters the required information, chooses delivery and payment methods, and can correct any errors before confirming. The final button clearly indicates that placing the order entails an obligation to pay. The order becomes binding once payment has been accepted and a confirmation has been sent on a durable medium.
The seller may refuse or cancel an order for a legitimate reason, in particular suspected fraud, unavailability, a legal prohibition on shipping the product or a previous payment dispute. Any sums received for an order cancelled by the seller are refunded.
Article 5 Availability
Products are offered while stocks last. If a product becomes unavailable after an order is placed, the customer is informed and refunded the corresponding sums without undue delay. A replacement is supplied only with the customer’s agreement.
Article 6 Payment
Payment is made using the methods offered on the website: bank card and the other payment methods shown on the checkout page. Payments are processed by Shopify Payments. The seller may carry out proportionate fraud prevention checks.
Article 7 Delivery
Delivery areas, costs and terms are described in the Shipping Policy. The delivery time or date is communicated before ordering. Failing this, the seller delivers no later than thirty days after the contract is concluded. In the event of failure, the customer may exercise the rights provided for in Articles L. 216-1 et seq. of the French Consumer Code.
The customer must provide an accurate address. Customs restrictions, duties and taxes applicable outside the European Union are set out in the Shipping Policy. The statutory rules on the transfer of risk to the consumer continue to apply.
Article 8 Withdrawal
Consumers have fourteen days from receipt of the goods to exercise their right of withdrawal, subject to the statutory exceptions. They may use the online function Withdraw from the contract here, the model form available for download here: withdrawal form (PDF), or any other unambiguous statement. Return procedures, exceptions and refunds are detailed in the Return and Refund Policy.
Article 9 Statutory guarantees
Consumers benefit from the statutory guarantee of conformity provided for in Articles L. 217-3 et seq. of the French Consumer Code and from the guarantee against hidden defects provided for in Articles 1641 et seq. of the French Civil Code. These guarantees apply regardless of any commercial guarantee.
In the event of a lack of conformity, consumers are entitled to have the goods brought into conformity by repair or replacement, under the statutory conditions, or failing that to a price reduction or termination of the contract. Bringing the goods into conformity is free of charge for the consumer. To make a claim, customers should contact our customer service (boutique@laruchotte.com or +33 3 80 20 04 79).
Article 10 Liability and product safety
The seller is liable for its obligations in accordance with applicable law. Nothing in these terms excludes or limits the consumer’s mandatory rights. The seller is not liable for damage resulting from use contrary to the product’s intended purpose, the instructions or reasonably expected precautions, without prejudice to mandatory rules, in particular those relating to defective products.
Knives and sharp utensils must be handled and stored with care, out of the reach of children. Food products must be stored and consumed in accordance with their labelling, particularly where allergens are present.
Article 11 Personal data
Data processing relating to orders is described in the Privacy Policy, which sets out the purposes, legal bases, recipients, retention periods, any transfers and the rights of individuals.
Article 12 Force majeure
Neither party is liable for any delay or failure to perform resulting from an event meeting the legal criteria of force majeure. The party concerned informs the other as soon as possible. Sums corresponding to a service that is definitively not performed are refunded where the law so requires.
Article 13 Complaints and mediation
Any complaint must first be sent to customer service: boutique@laruchotte.com, +33 3 80 20 04 79, or by post to La ferme de la Ruchotte, La Ruchotte, 21360 Bligny-sur-Ouche, France. If the dispute is not resolved, the consumer may refer it free of charge to the following mediator: ANM Conso (Association Nationale des Médiateurs), 2 rue de Colmar, 94300 Vincennes, France, www.anm-conso.com.
Article 14 Governing law and jurisdiction
These terms are governed by French law, without depriving consumers of the more protective mandatory provisions of their country of residence where these apply. In the event of a dispute, consumers may bring the matter before the competent courts under the ordinary rules. No clause requires them to use a court chosen exclusively by the seller.
Article 15 Evidence and archiving
Confirmations, invoices and electronic records kept under reasonable security conditions may constitute evidence. Customers receive the contractual information on a durable medium. Contracts subject to a legal archiving obligation are kept for the applicable period and may be consulted according to the procedures communicated by the seller.
Article 16 Severability, applicable version and language
If any provision is held to be unenforceable, the others remain in force. The binding version is the one accepted by the customer when placing the order. The seller may amend these terms for future orders.
These terms are a translation of the French original. In the event of any discrepancy between the French version and this translation, the French version prevails.
